On 1 May 2024, the UAE implemented Federal Decree-Law No. 51 of 2023 concerning Financial Restructuring and Bankruptcy, replacing the previous 2016 legislation.
This law introduces comprehensive procedures to assist distressed businesses, including:
- Preventive Settlement: This mechanism allows debtors to negotiate with creditors to restructure debts before insolvency occurs. - Bankruptcy Proceedings: In cases where preventive measures are insufficient, formal bankruptcy proceedings can be initiated, leading to liquidation of assets to satisfy creditor claims. An example would be a company unable to meet its financial obligations proceeding to sell its assets under court supervision to pay off debts.
The law applies to companies governed by the Commercial Companies Law, individuals with trader status, and licensed civil companies engaged in professional activities. It excludes natural individuals who are not classified as traders.
